The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 324, 326, 307, 447, 379, 302 of the Indian Penal Code. As per prosecution case, the informant alleged that when his father was returning home after closing his shop on 27.8.2021, in the meantime, three unknown miscreants reached there and assaulted him by means of knife due to which he succumbed to injury. The accused persons also snatched golden chain and 5000/- cash from the deceased and fled away. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in FIR rather he has falsely been implicated in this case due to the deceased and the petitioner

Patna High Court CR. MISC. No.13274 of 2023(2) dt.25-04-2023 2/2 belong to same vicinity. The name of the petitioner has sprang up in this case on his self confessional statement which has got no evidentiary value in the eye of law. There is no any eye witness of the alleged occurrence. Moreover, similarly situated co-accused namely, Nandu Kumar has already been granted bail by a coordinate Bench of this Court vide order dated 21.7.2022 passed in Cr. Misc. No. 17968 of 2022 and in support of this Annexure-2 has been annexed with this petition. The petitioner has got no criminal antecedent and languishing in judicial custody since 2.8.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sonepur P.S. Case No. 501 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra.
