2. The petitioner seeks regular bail in connection with Excise Patna P.S. Case No. 1715 of 2023 lodged under section 30(a) of Bihar Prohibition and Excise Amendment Act, 2016 & 2022.

3. As per the prosecution case, the F.I.R. has been lodged against the petitioner with allegation that he was kept 40 liter wine and the said recovery has been made in his presence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that petitioner is a common man and was going to home after finishing labour work and at the instance, police has arrested him on basis of suspicion.

5. Counsel further submits that petitioner is in custody since 17.11.2023 having clean antecedent.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, but only after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-3rd, Patna in connection with Excise Patna P.S. Case No. 1715 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
