JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Both petitions arise out of Kotwali (Aadampur) P.S. Case No. 910 of 2014 registered under Section-395 of the Indian Penal Code and accordingly, both the above-said petitions are being heard and disposed off by this common order. Heard learned counsels for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are not named in the first information

Patna High Court Cr.Misc. No.16981 of 2015 (3) dt.23-06-2015 2/2 report but in course of investigation, some witnesses claimed to have learnt the names of petitioners through conversations of culprits at the time of alleged occurrence. Admittedly, nothing was recovered from conscious possession of petitioners nor they have been put on test identification parade.

Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kotwali (Aadampur) P.S. Case No. 910 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Bhagalpur.
