====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-03-2023 Heard learned counsel for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offence punishable under Sections 323, 498(A), 494 of the IPC and section 3/4 of the Dowry Prohibition Act. As per the prosecution case, all the accused persons including these petitioners, committed torture, harassment due to nonfulfillment of demand of dowry. It is further alleged that on 05.09.2015 she was ousted from the matrimonial home. Petitioner no. 1 is father in law, petitioner no. 2 is

Patna High Court CR. MISC. No.6214 of 2020(4) dt.20-03-2023 2/2 mother in law. Thrust of accusation is against husband of the complainant. Petitioners are separate in mess and property and there is no specific allegation of torture and harassment against these petitioners.

Learned counsel appearing for the complainant vehemently opposes the prayer for bail.

Considering the same, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, in connection with Complaint Case No. 2123C/2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
