1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354(B) and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 26.03.2024 at about 08:00 PM, the informant and his family members were sitting at the door when at that time Pankaj Das's younger son, Krishna Kumar, was passing through

No.8115 of 2025(2) dt.06-03-2025 2/3 the door on a bicycle, but the bicycle fell on the wife of the informant on account of which she got injured, accordingly the informant and his wife went to the house of Pankaj Das to complain when it is alleged that accused persons assaulted them, his brother and elder son.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that even allegation of assault is not specific and on a trivial issue, the informant and his wife had gone to complain to Pankaj Das when the injury suffered by his wife on account of felling of the bicycle was not serious hence an altercation took place in which both sides assaulted each other. It is next submitted that petitioners are not criminals.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where
Patna High Court CR. MISC. No.8115 of 2025(2) dt.06-03-2025 3/3 the case is pending/successor court in connection with Banka P.S. Case No. 124 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. Accordingly, the instant anticipatory bail application stands allowed.
