Learned counsel appearing on behalf of the petitioner submits that vide order dated 22.11.2021 passed in Cr. Misc. No. 22835 of 2021, the petitioner was directed to be released on bail subject to furnishing of Bank Draft of Rs.2,00,000/- (Rupees two lacs) on his behalf by the owner of Tata 407 Pick up van bearing Registration No. BR 11 GB 7154 in favour of Bihar State Legal Services Authorities, Patna in the court below, but the owner of the aforesaid Tata 407 Pickup Van has been made accused in the present case, hence the said condition be modified.

Considering the aforesaid facts and submission of the

Patna High Court CR. MISC. No.4806 of 2022(2) dt.09-02-2022 2/2 learned counsel for the petitioner, let the petitioner be released on bail subject to condition that the Bank Draft of Rs.2,00,000/- (Rupees two lacs) be furnished before the court below by any of the bailor having sufficient immovable property within the jurisdiction of the concerned court.

With the aforesaid direction, the present modification application is allowed to the aforesaid extent and accordingly it stands disposed of.
