JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is a lady and is in custody since 20.12.2014 in connection with a criminal case registered for the offences punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned Senior Counsel, appearing on behalf of the petitioner, submits that there were several accused persons and the police after investigation have submitted chargesheet against all the accused persons except this petitioner as during course of investigation, the police could not find any evidence against this petitioner. Final form/report has been brought on the record by way of
Patna High Court Cr.Misc. No.8371 of 2015 (2) dt.10-04-2015 2/2 Annexure-2 to this application. In order to substantiate the allegation, the police have submitted chargesheet against other co-accused persons but not against this petitioner. Keeping in mind the submissions that the petitioner is a lady and the police found her, during course of investigation, not to be connected with the crime, I am inclined to grant her privilege of bail.
In view of the submissions made above, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (T) P.S. Case No.392 of 2014.
