JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-09-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A, 504 and 506/34 of the Indian Penal Code.
It is a case of abduction of the informant's daughter by the petitioner along with the accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that vide para-55 of the case diary, the victim was recovered and she gave her statement under Section 161 of the Cr.P.C. that she had went away on her own sweet will with co-accused Rahul Kumar Das at Delhi and lived there as
Patna High Court CR. MISC. No.3791 of 2022(3) dt.01-09-2022 2/2 husband and wife. He further submits that main allegation is against co-accused Rahul Kumar Das and not against this petitioner and there is no complicity of the petitioner in this case in committing abduction of the victim girl. Petitioner has clean antecedent.
Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Benipatti, Madhubani in connection with Bisfi P.S. Case No. 352 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
