JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 09-02-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Laukahi P.S. Case No.286 of 2023 registered under Section 307 and other allied sections of the I.P.C.

3. The allegation of assault upon the head of the informant's son with axe is against the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to previous land dispute. There is a case and counter case between both sides and they are neighbours. It is further submitted that the injury sustained by the injured is simple in nature caused by hard and blunt substance. The petitioner is in

Patna High Court CR. MISC. No.5883 of 2024(2) dt.09-02-2024 2/2 custody since 06.11.2023 having no criminal antecedent. The charge sheet has already been submitted and there is no chance of absconding or tampering with the evidence. The petitioner undertakes to cooperate in the trial.

5. Learned A.P.P. and learned counsel for the informant oppose the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. I, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No.286 of 2023.
