JUSTICE SUDHIR SINGH ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner, learned counsel for the Opposite Party and learned counsel for the Informant. The earlier bail application of the petitioner was rejected vide Cr.Misc.No.27531 of 2015 dated 31.07.2015 with a direction to the trial court to take all necessary steps for procuring the attendance of the witnesses and conclude the trial within a period of six months from the date of receipt/production of a copy of this order.

This is the second attempt for regular bail on behalf of the petitioner. A report was called for by the trial court and the same is kept at flag-'A'.

It has been submitted by the trial court that further period

Patna High Court Cr.Misc. No.8218 of 2016 (4) dt.11-05-2016 of two months may be granted so that the trial could be concluded within the said stipulated period. The trial court is directed to conclude the trial within a period of two months taking all necessary steps. The Superintendent of Police, Kaimur at Bhabua is also directed to ensure that the witnesses are produced on the date fixed by the trial court so that the trial could be concluded within the stipulated period.

The regular bail of the petitioner is rejected in connection with Sessions Trial No.2/15-1/15 arising out of Durgawati P.S.Case No.145 of 2014, G.R.No.1375 of 2014 pending in the court of Additional District & Sessions Judge-IV, Kaimur at Bhabua for the present with the above directions and the observations. If the trial is not concluded within the stipulated period, the petitioner will be at liberty to renew his prayer for bail. Let a copy of this order be sent to the Superintendent of Police, Kaimur at Bhabua.
