JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is said to have opened fire causing firearm injury to informant as well as her two sons but submission on behalf of the petitioner is that sons of the informant did not sustain any injury and so far as informant is concerned, she sustained simple injury though said to be caused by firearm. It is further submitted that informant is own sister of the petitioner and as a matter of fact, she wanted to take possession of house of the petitioner forcibly and she had collected several persons for taking
Patna High Court Cr.Misc. No.12333 of 2016 (2) dt.18-03-2016 2/2 forcible possession of petitioner's house and the aforesaid persons made firing but said firing caused injury to informant herself. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, taking note of this fact that petitioner is in jail custody since 01.05.2015 and the investigation of this case has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Nalanda at Biharsharif in connection with Bihar P.S.
