In this case, the petitioner is seeking bail in connection with Saraiya P.S. Case No. 267 of 2014 registered for offences under sections 341, 323, 504, 506, 307, 312, 379/34 of the Indian Penal Code.
Allegation has been made against the petitioner and other accused persons to have entered into the house of the information on 7th June 2014, caught hold her hair, dragged her and brought to the house of the petitioner where they tried to terminate the foetus of the victim. In that course, they have used tiles, putting on the belly and pressed by mounting on the belly of the deceased. She was treated in Kejriwal Hospital and released from where on 10th June 2014, fard beyan was recorded on 13th
Patna High Court Cr.Misc. No.4228 of 2015 (3) dt.10-04-2015 2/2 June 2014, the first information report was registered after much delay on 17th July 2014 and there is no explanation of delay in instituting the case.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate (West), Muzaffarpur in connection with Saraiya P.S. Case No. 267 of 2014.
