JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Harlakhi P. S. Case No. 64 of 2019, disclosing offences under Sections 366A/34 of the IPC.
As per F.I.R. there is allegation of kidnapping of minor daughter of the informant.
Learned counsel for the petitioner has drawn my attention towards the statement of the victim girl u/s 164 Cr.P.C. trying to convince the Court that the petitioner is not involved in the kidnapping, rather it is Vipin Kumar, who is involved in this case.
Heard learned A.P.P. as well as learned counsel for the informant who has opposed the prayer for anticipatory bail on the ground that it is the petitioner who facilitate the girl to come out from the house and thereafter, fled away.
Patna High Court CR. MISC. No.4076 of 2020(2) dt.22-01-2020 2/2 Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
