Petitioner along with others who happen to be active member of Maoist, a banned outfit indulged in cross-firing with police personnel and during course thereof, others managed to escape while petitioner, being injured, was apprehended having armed with country made pistol along with bandolier containing six cartridges, mobile etc, as per seizure list. From para-3 of the petition itself, it is evident that petitioner has got criminal antecedents. As such, prayer for bail, for the present, is rejected. The learned lower court is directed to expedite the trial and conclude the same within six months and for that the Superintendent of Police, Aurangabad is directed to produce all the witnesses within the
Patna High Court Cr.Misc. No.17007 of 2015 (2) dt.27-04-2015 aforesaid stipulated period, otherwise, he will have to submit an explanation by having his physical appearance. At the other end, if the trial is not concluded within the stipulated period of six months, petitioner will be at liberty to renew his prayer for bail.
