2. The petitioner is apprehending arrest in connection with Baikunthpur P.S. Case No. 260 of 2025 lodged on 19.07.2025, for the offence punishable under Section 126(2), 115(2), 118(2), 109(1), 303(2), 352, 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioner. It has been alleged in the FIR that the petitioner has attacked the informant's father with sharp cutting weapon due to which injury has been caused to him on his head and he became
2/4 unconscious and fell down. The other accused persons also assaulted the informant's side with tangi, knife etc.
4. Learned Senior counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Senior counsel submits that for the same date and place of occurrence, there are case and counter case from both the sides. He further submits that from the content of the FIR, it become crystal clear that due to agricultural related work, dispute occurred between the parties. Senior counsel submits that both the parties are relatives and resident of the same village. Senior counsel submits that as per the FIR, the specific allegation against the petitioner is that he has attacked the informant's father namely, Arun Kumar Singh by sharp cutting weapon due to which injury has been caused. The injury report of the informant's father has been attached and from the injury report, it become crystal clear that injury nos.
1 & 2 are grievous in nature caused by hard and blunt substance and injury no.3 is simple in nature caused by hard and blunt substance. Therefore, he submits that all the three injuries are caused by hard and blunt substance, but allegation against the petitioner is that he has attacked by sharp cutting weapon.
3/4 whom the petitioner has attacked. Senior counsel further submits that the petitioner has clean antecedent and he is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that the observation made by the doctor in the injury report does not match with the injury alleged in the FIR.

As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Judicial Magistrate 1st Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 260 of 2025, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.

The Trial Court is directed to verify the criminal antecedent(s) of the petitioner, and in case, it is found at any stage that the petitioner has concealed the fact about his criminal antecedent(s), the Trial Court shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of the bail
