The petitioner is languishing in custody since 28.12.2015 in a case registered for the offences punishable under sections 20(b)/21/22/27 of The Narcotic Drugs and Psychotropic Substances Act.

From the betel-shop of the petitioner 83 satchels of 'ganja' total weighing 340 grams were recovered. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the betel-shop from where the recovery has been made belonging to the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the small quantity of recovery coupled
