The petitioner is apprehending arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case as per the written report of Bhaskar Yadav submitted to SHO, Chainpur Police Station is to the effect that on 18.11.2018, he along with other police officials were on patrolling duty, as soon as he reached near Chainpur Block, a secret information was received that the petitioner, Sanoj Kumar Rawat was selling illicit liquor in his village.

No.2260 of 2019(2) dt.05-02-2019 2/3 Thereafter, a raid was laid in the house of the petitioner, Sanoj Kumar Gupta, and on seeing the police, he threw the white bag and escaped from the scene. It is further alleged that on search being made of white bag, 22 pieces bottles containing 180 ml each of foreign liquor were recovered.

It is submitted by learned counsel for the petitioner that the recovery has been made from the lane adjacent to the house of the petitioner. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent.

It is submitted by learned APP for the State that the petitioner is named in the FIR and on seeing the police, he escaped from the scene.

Considering the fact that the recovery has been made from the lane adjacent to the house of the petitioner, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions
