The petitioner seeks bail in connection with Rajnagar P.S. Case No.315 of 2019/G.R. No.2133 of 2019 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that in course of patrolling duty by the informant and other police personnel, one four wheeler vehicle was seen coming. On seeing the police vehicle, the aforesaid four wheeler vehicle was tried to be turn down but the aforesaid four wheeler vehicle bearing Registration No.WB 2N4070 was stopped. Patna High Court CR. MISC. No.2748 of 2020(2) dt.24-01-2020 2/2 were apprehended, who disclosed their name as Ramesh Paswan (petitioner/driver) and Sanjay Kumar Paswan. On search of the aforesaid four wheeler vehicle, four sacks, each containing 150 bottles of 300 ml. Nepali Liquor, were recovered. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not the owner of the aforesaid four wheeler vehicle rather he was passing through the road. On mere suspicion, the petitioner was apprehended by the police. The petitioner having no criminal antecedent is in custody since 09.11.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge Excise Act, Madhubani, in connection with Rajnagar P.S. Case No.315 of 2019/G.R. No.2133 of 2019.
