The petitioner has been in custody since 15.10.2014 in a case registered for offences under section 394 of the Indian Penal Code in connection with Barauni P.S.Case No. 507/2013. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and the name of the petitioner has surfaced on the basis of confessional statement made before the police by one co-accused Saket Kumar and the petitioner was taken into custody only on mere suspicion. It is further submitted by the petitioner that till date he has not been put on T.I.P. and there has been no recovery from him.
Considering the aforementioned submissions and also the
Patna High Court Cr.Misc. No.9308 of 2015 (2) dt.10-04-2015 2/2 fact that the petitioner is in custody since 15.10.2014 and his name has surfaced on the basis of the confessional evidence of coaccused which has no evidentiary value, let the petitioner Vikash Kumar Mandal @ Vikash Mandal be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begsuarai in connection with Barauni P.S.Case No. 507 of 2013.
