JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks regular bail in connection with Khajauli P.S. Case No. 131 of 2019 registered for the offences punishable under Sections 413, 414, 34 of IPC and Sections 25(1-b)a, 26 & 35 of the Arms Act.
As per F.I.R. petitioners were arrested while fleeing away with the stolen motorcycle.
Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case, having no criminal antecedent. They are in custody since 17.08.2019. Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that they have been arrested at the spot by the police.
Patna High Court CR. MISC. No.2527 of 2020(2) dt.20-01-2020 2/2 Having heard both sides, in view of the submissions, made above, I am not inclined to grant bail to the petitioner at this stage. However, once the charge has been framed in this case, petitioners are at liberty to renew their prayer for bail. With the above observations, this application is dismissed.
