JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Nautan P.S. Case No.167 of 2012 registered under sections 302/201 of the I.P.C. pending in the Court of Adhoc Additional District JudgeVth, Siwan. The accusation is that the marriage of the daughter of the informant was performed before 7 years with this petitioner. After some times, quarrel started in between them, while the matter was pacified, but on 07.12.2012 the informant received information about throwing the dead body of his daughter near the canal in village Gosaitola and he went there and found the dead body of his daughter sustaining sign of injury.

No.9729 of 2016 (3) dt.29-04-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that admittedly petitioner is husband of the deceased and she committed suicide due to making complaint regarding her illicit relation with others but the petitioner has been falsely implicated and he is in custody since 20.01.2013. The dead body of the deceased was found near the canal near to the in-laws' house of the deceased and the cause of death is shown as asphyxia due to strangulation in postmortem report.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
