JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 This is an application for grant of anticipatory bail in connection with Chakia P.S. Case No. 135 of 2018, disclosing offences under Sections 406 and 409 of the Indian Penal Code. Allegation against the petitioner, who was an Assistant Engineer in Nagar Panchayat, Chakia, East Champaran, is of not doing the work properly of road construction and also allegation of defalcation of money. Submission of learned counsel for the petitioner is that the payment was made as per the measurement and there is no case of defalcation against the petitioner. Further, he has no criminal antecedent.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the Lokayukt has
Patna High Court Cr.Misc. No.6658 of 2019(2) dt.05-02-2019 2/2 also the guilt of the petitioner in his enquiry. Having heard both sides, considering the above facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of six weeks and on surrender he will be released on bail by the court concerned to his own satisfaction till submission of charge-sheet with the condition to cooperate in investigation of the case and produce all the papers before the Investigating Officer in support of his case, even after charge-sheet is submitted against the petitioner, he has to surrender and make prayer for regular bail, which will be considered on its own merit without being prejudice by order of this Court.
