The petitioner has been in custody since 1.12.2014 in connection with Barharia (G.B. Nagar) P. S. Case No. 524 of 2014 registered under Sections 379, 461, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner contends that there has been no recovery of the stolen motorcycle from the possession of the petitioner and that the motorcycle alleged to have been recovered belongs to him.

Considering the aforementioned submissions and also the fact that the number of the motorcycle as alleged in the F. I. R. is not tally with the motorcycle, mentioned in the seizure list, let the
