JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are accused in connection with Kalyanpur P.S.Case No. 169 of 2015 registered under Sections 328 and 379 of the Indian Penal Code.
Submission of learned counsel for the petitioners is that the petitioners are not named in the FIR. After fifteen (15) days of the occurrence, Md. Jahangir, father of the informant claimed to have identified the petitioner at Chowk involved in the theft. Thereafter the petitioner was apprehended by the police on the same day and remanded in this case. Further submission is that no incriminating article has been recovered from the possession of the petitioner. The petitioner having no criminal antecedent is in
Patna High Court Cr.Misc. No.9687 of 2016 (3) dt.28-04-2016 2/2 custody since 10.12.2015.
Having considered the facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Kalyanpur P.S.Case No. 169 of 2015 corresponding to G.R.No. 2869 of 2015. Out of two sureties, one surety must be the close relative/ parents of the petitioners.
