This application has been filed for quashing of the order dated 10.02.2021 passed by learned S.D.J.M, Kaimur at Bhabua in connection with Mahila P.S. Case No. 81 of 2019 by which learned Magistrate has taken cognizance for the offences under Section 498A, 312 of the Indian Penal Code and 3⁄4 of the D.P. Act.

Prosecution story in short is that the marriage was solemnized between the informant and Abhishek Kumar Singh on 19.04.2018. At the time of marriage, 30 lack cash and other goods were given but after two days the accused persons

Patna High Court CR. MISC. No.7514 of 2023(2) dt.29-04-2023 2/2 demanded four wheeler vehicle from the informant's father. On account of non-fulfillment of the demand, the accused persons started torturing the informant physically and mentally. It is further alleged that at the time of pregnancy all the accused persons assaulted her in such a way that her child died. From reading of the entire F.I.R, it appears that there are serious allegation against the petitioner and prima facie case is made out against the petitioner.

Considering the aforesaid facts, this Court is not interfering in the matter. Accordingly, this application is dismissed with liberty to the petitioner to raise all the grounds at the stage of framing of charge.
