The petitioner has been in custody since 15.10.2014 in connection with Rajepur P. S .Case No. 81 of 2014 registered under Sections 387/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the allegation made out in the First Information Report does not concern him at all and he is not named in the same. It is further submitted that the petitioner was arrested in connection with Rajepur P. S. Case No. 85/2014 and while he was in custody in connection with the same, his confession statement was recorded before the police in which he has confessed his complicity in the
Patna High Court Cr.Misc. No.9317 of 2015 (2) dt.10-04-2015 2/2 present case.
Learned counsel for the petitioner contends that even in the said case, the F.I.R. has been registered against unknown persons and also one accused namely Raushan Kumar and in that case the petitioner Umesh Kumar Rai has been extended regular bail by this Hon'ble Court on 20.02. 2015 in Cr. Misc. No. 7115 of 2015.
Considering the aforementioned submissions and also the fact that the petitioner has made confession before the police which has no evidentiary value, let the petitioner Umesh Kumar Rai be released on furnishing bail bonds of Rs. 10,0000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikharahana at Motihari in connection with Rajepur P.S.Case No. 81 of 2014.
