JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-04-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Rani Talab P.S. Case No. 22 of 2015 registered for the offences punishable under Sections 304(B), 201 and120(B)/34 of the Indian Penal Code.

Nikki Devi was married to Navlesh Sharma in the year 2012 and allegedly, due to non-fulfillment of demand of dowry by way of motorcycle and gold chain, she was being tortured and assaulted and for that earlier a case under Section 498-A IPC was filed but on the undertaking given by the husband she started living again in her in-laws house from where she was eliminated. Submission is of false implication and that the petitioner is father-in-law of the deceased, earlier case under

Patna High Court Cr.Misc. No.9887 of 2016 (4) dt.13-04-2016 2/2 Section 498-A was filed only against the husband and, as such, it is apparent that the deceased was being tortured by the husband only and the petitioner has got no concern, the wife of the petitioner has already been allowed bail vide Cri. Misc. No. 353 of 2016 by another co-ordinate Bench of this Court and, as such, the petitioner also deserves sympathetic consideration to which the learned A.P.P. does not dispute.

In the facts and circumstances stated above, the petitioner, who is the father-in-law, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. Kumar Madhvendra, learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Rani Talab P.S. Case No. 22 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
