JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-11-2021 Heard Mr. Birendra Kumar, learned Advocate for the petitioner and Mr. Bimal Kumar for the informant. The State is represented by Mr. Ram Priya Sharan Singh, learned APP.

The prayer for bail of the petitioner was earlier rejected vide order dated 04.12.2019. This Court had directed the trial court to conclude the trial within a period of one year.

The report which has been received from the court below indicates that out of 15 chargesheeted witnesses, only one witness has up till now been

Patna High Court CR. MISC. No.17009 of 2021(3) dt.17-11-2021 2/2 examined.

However, notwithstanding the fact that the petitioner is in custody since 21.06.2019, I am not inclined to grant bail to him in view of the nature of accusation against him.

The prayer for bail is rejected.

However, the trial court is directed to conclude the trial positively within a period of nine months from the date of receipt/production of a copy of this order. If there is no substantial progress in the case in the next six months, it would be open for the petitioner to approach this Court again.
