The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 302, 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while accused Vikas and two others caught hold of Dharmendra, it is stated that Kundan fired on him as a result of which he fell down injured and subsequently died.

It is submitted by learned counsel for the petitioner, that the petitioner is not named in the F.I.R. His named transpired in the confessional statement of co-accused made before police.

Patna High Court CR. MISC. No.14021 of 2021(3) dt.04-08-2021 2/2 No incriminating article has been recovered from the petitioner's possession. He has not been put on T.I. parade and is in custody since 11.9.2020. He has no criminal antecedent and investigation in the case has concluded.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner not having been put on T.I. parade and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Phulwarisharif P.S. Case no. 493 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub JudgeIX-cum-Additional Chief Judicial Magistrate, Patna.
