JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother-in-law of the deceased and is languishing in jail custody since 03.12.2015 in a case initially registered under section 307 of the Indian Penal Code but later on converted into section 302 of the Indian Penal Code. The informant/deceased gave written statement that her mother-in-law and father-in-law poured kerosene oil and lit fire on her body.
The contention on behalf of the petitioner is that the father-in-law of the informant/deceased has already been granted privilege of bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.11643 of 2016 (2) dt.15-03-2016 2/2 dated 28.08.2015 passed in Cr. Misc. No. 35710 of 2015 and the case of the petitioner more or less stands on similar footing. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of subDivisional Judicial Magistrate, Birpur, Supaul in connection with Karjain P.S.Case No. 29 of 2014.
