====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 366 and 376 of the IPC.

The prosecution story, in brief, is that on 23.06.2018, Sanjeet Kumar Sharma (petitioner) induced the informant giving assurance to marry with her and taken away at VillageBauk, P.S. Akodhigola and kept in the house of co-accused Gorakh Sharma and with the help of Gorakh Sharma and his wife Rinki Devi, after eight days taken away to Ranchi and from where Tata and on assurance to marry with her continuously established physical relation with her. Thereafter, on 15.07.2018

Patna High Court Cr.Misc. No.2308 of 2019(2) dt.17-01-2019 2/3 all accused persons snatching her ornaments droved her away from the house. It is further alleged that all accused persons have also assaulted her given threatened to kill her. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The statement of the victim girl has already been recorded before the police under Section 161 of Cr. P.C. in which she had stated that on assurance of marriage she left her house with this petitioner. The victim is already a married lady. Later on, it is alleged that the petitioner denied to get married with the said victim girl. Hence, the present prosecution has been brought against the petitioner. The allegation made in the F.I.R. is denied by the petitioner.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the
