JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-01-2023 Heard learned Counsel for the parties concerned. The grievance of the petitioner in the present writ application is with regard to non-payment of compensation to him in lieu of the land belonging to the petitioner having been acquired by the respondent-authorities.
Learned Counsel for the petitioner submits that the petitioner is entitled to be paid half of the compensation amount, but the entire compensation amount has been paid to respondent no. 6.
Learned Counsel for the State, referring to Section 51
Patna High Court CWJC No.20405 of 2018(3) dt.16-01-2023 2/2 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, submits that an authority, namely, the Land Acquisition, Rehabilitation and Resettlement Authority (in short, 'LARRA') has been constituted and the petitioner can raise his grievance regarding non-payment of compensation to him before the LARRA. Taking into consideration the nature of dispute, the petitioner is permitted to raise his claim regarding payment of 50 per cent of the compensation amount before the LARRA within a period of one month from today.
With the aforesaid observation and direction, this writ application is disposed.
