JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-02-2021 Though the present writ petition was initially filed for setting aside the order passed by the Eastern Regional Committee and National Council for Teacher Education passed in its 271th meeting held on 24/25th April 2019, refusing to grant recognition to the petitioner college for the B.Ed. course, as communicated to the petitioner vide order dated 28.08.2012 as also for quashing the appellate order dated 23.12.2019, nonetheless, the learned senior counsel appearing for the

Patna High Court CWJC No.1112 of 2020(4) dt.04-02-2021 2/3 petitioner college, Shri Sanjay Singh has limited his submission to the extent that the petitioner would be approaching the Eastern Regional Committee, National Council for Teacher Education by filing a fresh application for grant of recognition for conducting the B.Ed. Course as per the rules/regulations and the time schedule prescribed by the Hon'ble Apex Court in the case of Maa Vaishno Devi Mahila Mahavidyalaya v. State of U.P., reported in (2013) 2 SCC 617, however, it is the submission of the learned senior counsel that the Eastern Regional Committee, N.C.T.E. be directed to consider the application of the petitioner college sympathetically inasmuch as the petitioner college has once already been granted recognition for conducting B.Ed.

Course, by the Eastern Regional Committee, N.C.T.E. vide order dated 29.12.2012, which had been further confirmed vide order dated 23.05.2015. The learned counsel for the N.C.T.E. Shri Sunil Kumar submits that if the time schedule prescribed in the case of Maa Vaishno Devi Mahila Mahavidyalaya (supra) is adhered to by the petitioner college, the Council would definitely take necessary steps for conducting inspection etc. of the petitioner college and would also consider the case of the petitioner college for grant of recognition for conducting B.Ed.

Patna High Court CWJC No.1112 of 2020(4) dt.04-02-2021 3/3 course with appropriate annual intake capacity for the next session, in an objective manner.

Accordingly, the present petition stands disposed off with the consent of the parties on the aforesaid terms. It is needless to state that the time schedule prescribed by the Hon'ble Apex Court in the case of Maa Vaishno Devi Mahila Mahavidyalaya (supra) shall be strictly adhered to both by the Council and the petitioner college.
