2. Petitioner seeks regular bail in connection with Excise P. S. Case No. 878/2023 in a case registered for the offence punishable under Section 30(a), 32(1), 32(3), 41(1), 41(2) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 525 litre spirit was recovered from Bolero car.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Name of the petitioner transpired on the basis of confessional statement of co-accused. Petitioner is neither driver nor owner of the vehicle in question. Petitioner is in custody since 27.11.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner has got nine criminal antecedents of similar nature .
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Second, Aurangabad in connection with Excise P. S. Case No. 878 of 2023.
