JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Basantpur P.S. Case No. 216 of 2015, registered under Sections 284, 328, 273, 308 and 302 of the Indian Penal Code. The accusation is that on 09.10.2015, in the evening, Birendra Yadav, son of the informant had gone to the house of Bhrigu Ram for taking liquor. On the next day, son of the informant started vomiting and he was rushed to the hospital, where he died during the course of treatment. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. in course of investigation, confessional statement of Bhirgu Ram has been recorded, who disclosed the name of petitioner showing

No.9263 of 2016 (2) dt.05-04-2016 2/2 his involvement in the present case to the effect that this petitioner used to supply the country made liquor, except the confessional statement, there is nothing on the record against the petitioner. The petitioner having no criminal antecedent is in custody since 20.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 216 of 2015.
