====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-05-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner seeks bail in a case registered for offence under Sections 302, 498(A), 201/34 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.

3. As per prosecution case, daughter of the informant was married with co-accused Dhananjay Choubey on 20.04.2014 and after the marriage, all the accused persons including this petitioner started demanding dowry from deceased and due to non-fulfillment of the same, they started torturing her and on 21.06.2023, the daughter of the informant was killed by the accused persons.

4. Petitioner is father-in-law of the deceased and there

Patna High Court CR. MISC. No.14622 of 2024(4) dt.17-05-2024 2/2 is general and omnibus allegation against him. Thrust of the accusation is against husband of the deceased, who is already in custody. Petitioner is separate in mess and property and has got no concern with the family affairs of the couple. Petitioner is in custody since 22.06.2023. Chargesheet has been submitted.

5. Learned counsel for the informant vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Ramgarh P.S. Case No. 213 of 2023.
