The petitioner in this case is seeking anticipatory bail in connection with Patori P.S. Case No. 390 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.
In view of the allegation that the illicit liquor has been found from the house of this petitioner, in view of the Full Bench judgment of this Hon'ble Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in 2019 (2) PLJR 1089, there being some material to connect this petitioner with this case, this Court is not inclined to entertain this application for grant of anticipatory bail. Accordingly, this
Patna High Court CR. MISC. No.2166 of 2020(2) dt.16-01-2020 2/2 application stands dismissed.
In case the petitioner surrenders and prays for regular bail within a period of four weeks from today before the learned court below, his prayer for regular bail shall be considered on its own merit without being prejudiced by the present order of this Court.
