JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.
Petitioner is named in the first information report and it is stated that he, too, participated in the alleged crime and assaulted the deceased on his right chest with fists and slaps. Admittedly, the petitioner was unarmed at the time of alleged occurrence and other co-accused also assaulted the deceased. Learned counsel appearing for the petitioner submits that cause of death of the deceased is said to be his head injuries which is evident from perusal of his post mortem report. On the other hand, learned counsel for the informant
Patna High Court Cr.Misc. No.17222 of 2015 (4) dt.14-05-2015 2/2 submits that three right ribs of the chest of the deceased were found broken.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna in connection with Fatuha P.S.case No. 244 of 2013.
