JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is languishing in jail since 22.10.2015 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 498A, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment o the dowry demand and making assault.

It is submitted by learned counsel for the petitioner that there is no injury report of the informant on record. The petitioner admits his marriage with the informant and he is still ready to keep the informant as wife with full dignity and honour, statement to that effect has been made in para 9 of the petition, which reads as follows:-

Patna High Court Cr.Misc. No.10712 of 2016 (2) dt.03-03-2016 2/2 "That the petitioner is ready to keep his wife." It is further submitted that the informant has performed second marriage with one Pramod Sharma.

Moreover, investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Mahila (Chatauni) P.S. Case No. 32 of 2014.
