JUSTICE SUDHIR SINGH ORAL ORDER 11-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Katihar Rail P.S. Case No. 02 of 2015 for the offences instituted under sections 333 of the Indian Penal Code and section 20/22 of the N.D.P.S. Act.

The prosecution story, in brief, is that on the alleged date of occurrence the informant was patrolling along with other police personnel at Railway Platform at Kishanganj. During patrolling the informant nabbed the petitioner and on search 30 tablets of Activan was recovered from his possession. It has been submitted on behalf of the petitioner that as per F.I.R. 30 tablets of Activan is said to have been recovered from possession of the petitioner and for that only the

Patna High Court Cr.Misc. No.16565 of 2015 (2) dt.11-06-2015 present prosecution has been brought against him. The petitioner has got no criminal antecedent and he is in custody since 04.02.2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge Ist-cum-Special Judge, Katihar in connection with Katihar Rail P. S. Case No. 02 of 2015 giving rise to G.R. Case No. 8 of 2015.
