Mr. Sunil Kumar Sharma, learned counsel for the respondents is present.
The respondent is the plaintiff in the eviction suit filed against the defendant -petitioner bearing Eviction Suit No. 01 of 2009 / 01 / 2014.
Learned counsel for the respondents submits that the present application has become infructuous inasmuch as eviction suit has already been disposed and judgment and decree has been passed by the learned trial court on 25-10-2018 / 0611-2018. He further submits that title appeal preferred by the petitioner bearing T.A. No. 40 of 2018 has also been dismissed
Patna High Court C.Misc. No.1591 of 2018(2) dt.12-10-2022 2/2 on 30.09.2019 and Second Appeal preferred thereto by the petitioner vide S.A. No. 631 of 2019 has also been dismissed on 04.08.2022.
In view of the aforesaid submission made by the respondents, this application is dismissed as infructuous. (Anil Kumar Sinha, J) praful/- U
