The petitioners seek anticipatory bail in connection with Muffasil P.S.Case No. 149 of 2016, registered for offences punishable under Sections 420, 467, 468, 471 and 120 (B) of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is that under some conspiracy the petitioners along with others got the land transferred to some other person.

Submission of the learned counsel for the petitioners is that they have not committed any offence and neither the petitioners temper any documents nor knowledge about the illegal transfer of the land and they have already handed over the consideration amount and this case is purely of civil in

Patna High Court CR. MISC. No.3121 of 2019(3) dt.07-03-2019 2/2 nature and the petitioners have no criminal antecedents. It is further submitted that the similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc . No. 28630 of 2017.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Muffasil P.S.Case No. 149 of 2016, to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
