The petitioner apprehends his arrest in Mothihari Town P.S. Case No.49 of 2007 registered under Section 20 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is submitted that no recovery was made from his possession. The name of the petitioner has surfaced in the case on the basis of confessional statement of apprehended accused Lilawati Devi. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a

Patna High Court CR. MISC. No.14771 of 2021(2) dt.20-12-2021 2/2 period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional Sessions Judge II, Motihari, East Champaran in connection with N.D.P.S. Case No.76 of 2007 arising out of Mothihari Town P.S. Case No.49 of 2007, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
