Petitioner is an Assistant Commissioner in the Department of Commercial Taxes, Government of Bihar. He wants grant of promotion as Deputy Commissioner because according to him, he fulfills all the eligibility for such consideration. However, since no decision on such claim is being taken under certain background, petitioner decided to file the writ application. Since the ban imposed by the Department of General Administration against holding of DPC for grant of promotion is withdrawn vide notification dated 01.04.2016, the writ application
Patna High Court CWJC No.4286 of 2016 dt.19-05-2016 2/2 even otherwise should be disposed of with a direction upon the respondents that the question of consideration for promotion of the petitioner to the next higher post should now be considered and expedited.
Counsel for the State informs the Court that the respondents are willing to consider the claim of the petitioner. The Court could expect that a decision in this regard should be taken within a reasonable time preferably within a period of four months from the date of production of a copy of this order. The writ stands disposed of in terms of the above direction.
