JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Giriyak P.S. Case No. 129 of 2015, registered under Sections 304(B), 201/34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant due to non-fulfillment of demand of dowry by her husband and other in-laws and also to dispose of the dead body of the deceased without giving any information to the informant. Learned counsel for the petitioner submits that admittedly the petitioner is the husband of the deceased and marriage of the petitioner was performed seven years ago. No.9838 of 2016 (3) dt.03-05-2016 2/2 son of the informant and sister of the petitioner has three children, whereas the deceased was issueless and she was living in frustration and due to that reason, she committed suicide. After giving information to the informant, the dead body was disposed of, but due to ulterior motive this case has been lodged. The chargesheet has already been submitted in this case. The petitioner is in custody since 06.08.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda in connection with Giriyak P.S.
