2. The petitioner seeks regular bail in connection with Ramkrishna Nagar P.S. Case No. 777 of 2023, lodged on 26.11.2023 under Sections 25(1-b)a/26/35 of the Arms Act read with sections 8, 20(b)(ii)(A), 25, 29 of the N.D.P.S. Act.

3. As per the prosecution case, FIR has been lodged against two named accused persons including the present petitioner. One desi katta and 259 grams of ganja was recovered which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the antecedent of the petitioner is clean and he in custody since 26.11.2023. Counsel also submits that

Patna High Court CR. MISC. No.5349 of 2024(2) dt.07-02-2024 2/2 because of police, name of the petitioner has been figured in this case. Counsel submits that the said recovery of ganja is small in quantity.

5. Upon specific query of the Court from the counsel for petitioner that whether charge has been framed in this case or not, counsel submits that as per his knowledge, he is not aware that whether charge has been framed or not.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. In the present facts and circumstances of this case and the submissions made above considering the antecedent of the petitioner, let the petitioner above named be granted bail, four months after framing of charge, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-cum-Special Judge, N.D.P.S., Patna in connection with Ramkrishna Nagar P.S.
