The petitioner seeks bail in a case registered under Sections 147, 148, 149, 120(b), 302 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner along with other accused persons is alleged to have made indiscriminate firing causing death of Yogendra Singh and Jay Govind Singh, the brothers of the informant. Learned counsel for the petitioner submits that similarly situated co-accused Shambhu Singh @ Shambhu Sharma, Ravi Pandey and Srikant Pandey were granted bail. Shambhu Singh @ Shambhu Sharma was granted bail in the year 2013. Ravi Pandey, after remaining in custody for a substantive period, was granted bail in the year 2009. Srikant Pandey was a conspirator. Two persons were killed in the

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on bail in Pauthu P.S. Case No. 31/07. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt/production of copy of this order.

The Superintendent of Police, Aurangabad is directed to ensure the attendance of the prosecution witnesses in court so that the trial must conclude within the aforesaid period of one year.
