JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have pressed the neck of informant's son and ligature mark was also found on the neck of informant's son but submission on behalf of the petitioner is that petitioner is in jail custody since 13.01.2015 and as a matter of fact, informant is not an eye witness of the alleged occurrence and prior to institution of the present case, the father of the petitioner lodged case against Dipu Yadav and some others and in that case, the name of informant of the present case was also surfaced and that is the reason of implication of the petitioner in the alleged crime.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.16655 of 2015 (4) dt.21-09-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kuchakot P.S. Case No. 291 of 2014.
