The petitioner seeks his bail in Falka (Pothia) P.S. Case No.163 of 2014 registered under Section 376 of the Indian Penal Code. The informant made allegation that the petitioner made physical relation with her It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. From perusal of the FIR itself, it appears that the physical relationship established between the petitioner and the informant, i.e. with consent and the consented relation between two carried on for a long time but when it came to the notice of the mother of the informant, got the present case filed by the informant. The petitioner has been falsely implicated in the present case and is in custody since 10.2.2015. Considering the facts aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar, in connection with Falka (Pothia) P.S.Case No.163 of 2014.
