Petitioners seek bail in a case registered for the offences punishable under Sections 420, 467, 468, 409, 471, 120B of the Indian Penal Code.
The first information report was lodged by the President of Madarsa Islamiya Islahul Muslemin, Mahendrapur,
Patna High Court Cr.Misc. No.14063 of 2016 (2) dt.06-04-2016 Purnea (Annexure 1) which is based on the inquiry report. Petitioners' earlier application for bail was rejected vide order dated 16.10.2015 passed in Cr. Misc. no. 34481 of 2015, however, a liberty was granted to the petitioners to renew their prayer for bail after framing of charge.
It is contended that charges have now been framed vide Annexure-3 dated 22.12.2015. It is further contended that the petitioners have already remained in custody since 04.06.2015. Having regards to the facts and circumstances of the case, let the petitioners, namely, Md. Manjar Alam and Md. Asad Alam be released on bail on furnishing bail bonds of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) P.S. Case No. 192/2015.
However, the petitioners would be required to remain present during trial on each and every date and failing to appear on two consecutive occasions without any reasons to the satisfaction of the court concerned, the court concerned would be at liberty to take steps for cancellation of their bail bond.
